Privacy Policy

  1. PERSONAL DATA COLLECTION

    (a). According to the Malaysian Personal Data Protection Act 2010, personal data is any means of directly or indirectly identifying a natural person and includes sensitive personal data (e.g. personal data consisting of information as to the physical or mental health or condition, political opinions, religious beliefs or other beliefs of a similar nature, the commission or alleged commission of any offence) and expression of opinion about that individual.

    (b). AFV may be required to collect, store or even use the following data: the IP address, the visitor's number of the user's website, the statistics on the pages viewed, the conversation history, the browsing history, physical coordinates (city for example), and any other information provided by the user (name, email address, phone numbers, national registration numbers, profession) or resulting in a possible identification.

    (c). For the purpose of the Service provided or to be provided by AFV, AFV may collect all the above data (“Personal Data”) necessary for the proper functioning of the Service and the execution of its contract with Subscriber pursuant to the Subscription Plan as a data processer.

    (d). Personal Data may be provided by Subscriber, its Account Administrator, or Signer themselves. They may be collected and processed when you browse, use or access the TrueSigner™ Solution platform, register for its Service (free or otherwise), during the subscription or enquiry process via any means of communication on any platform and during the set up and use of the Service. It is the responsibility of Subscriber to ensure the consent of anyone whom Personal Data is being collected by AFV on the TrueSigner™ Solution platform is obtained beforehand (hereinafter referred to as Subscriber Data).

    (e). In those circumstances, Subscriber is the data controller and is responsible for most aspects of the processing of the Personal Data. If you have any questions or concerns about how personal information is processed in these cases, including how to exercise your rights as a data subject, you should contact Subscriber (either your employer or the individual or entity requesting your signature). If we receive any rights requests concerning instances where we act as data processor, we will forward your query on to the relevant Subscriber.

  2. PROTECTION OF SUBSCRIBER DATA

    AFV undertakes to apply the administrative, physical, and appropriate technical measures to protect the security, confidentiality and integrity of Subscriber’s Data, and to enter into a data processing agreement with the Subscriber, whereby the Subscriber’s obligations as data controller of his customers, officers or personnel and AFV’s obligations as processor thereof will be duly addressed.

    AFV refrains from (a) modifying the Subscriber's Data, (b) disclosing the Subscriber's data unless AFV is legally required or if AFV is expressly authorized by the Subscriber, or for the purpose of providing the Service or prevent or resolve technical problems or the user's request for customer support issues.

  3. SUBSCRIBER RIGHTS

    In accordance with the PDPA, all users of the Service have the following statutory rights on their personal data:

    • the right of access to own personal data;
    • the right to require us to correct personal data if it is inaccurate, incomplete, misleading, or outdated;
    • the right to withdraw consent to the processing of personal data;
    • the right to prevent processing likely to cause damage or distress; and
    • the right to prevent processing for direct marketing purposes.

    These rights may be exercised by simple request by email to the email address: support@truesigner.net. AFV’s responsibility in this regard is to forward the requests to the respective Subscriber as data controller.

  4. USE OF COOKIES BY THE END USER

    AFV use cookies and other storage devices for the operation of its applications and software. In the case of AFV, the use of cookies or storage devices makes it easier to navigate between web pages, to establish a history of previous visits, and to recognize the end user on future visits. As a result, they greatly facilitate navigation and service to the user.

    Thus, if the end user withdraws his consent on the use of cookies by setting his browser, it cannot be recognized during his next visit to the site of the co-contracting company and information about him cannot be found.

    It is the customer's responsibility to prevent the use of cookies and to ask for his prior consent.
